Blue Island Adventures
Payment Terms
Short-term charters (1 to 2 days):
● 50% of the agreed charter fee to confirm the booking.
● Remaining 50% of the agreed charter fee must be paid not later than 10 days before
departure.
Long-term charters (longer than 2 days):
● 50% of the agreed charter fee to confirm the charter.
● Remaining 50% of the agreed charter fee must be paid not later than 2 months before
departure.
(Subject to change instructed by The Owner)
Cancellation Fees Short-term charters (1 to 2 days):
In the event that Blue Island Adventures considers the weather condition to be unsuitable for the
charter or encounters other unexpected issues or difficulties which result in not being able to
make the vessel available as stated in the charter booking form, we will inform the Client at the
earliest opportunity before the charter. The Client will then be entitled to:
● Change to a different vessel in similar or higher size and price (subject to availability).
● Change the day of departure.
However, in the event of force majeure Blue Island Adventures cannot be held responsible and
therefore advises that the Client takes personal insurance to cover for these events.
Safety
To ensure the highest standard of safety is maintained and practiced the following should be
noted:
Life jackets – Blue Island Adventures will provide enough life jackets for all the Client’s guests
on board, including adults and children as per Charter Booking Form.
Fire extinguishers – there are fire extinguishers on board to be used in emergency only, and the
Client is requested not to tamper with these.
Life raft – a life raft is provided on board.
First aid – a standard first aid kit is provided as well as crew and captain trained for first aid and
life-saving skills.
Water sports – Blue Island Adventures shall not take any responsibility in any water sports
activity including but not exclusive to swimming, snorkeling, diving, water-ski, jet-ski, fishing,
etc. The Client may engage in those solely at their own risk. It is highly recommended that
personal insurance is also taken to cover these and any other activities.
Unsafe weather condition – Blue Island Adventures reserves the right to cancel or make
amendments to departure times, dates, itineraries, or any other relevant detail of the charter in the
event that it is reasonably deemed that the weather is unsafe for the charter or other adverse
condition may present an unsafe environment for the charter.
Authority and responsibility – Blue Island Adventures reserves the right for its captain, crew and
hostess to have full authority to carry out any amendments to the charter considered to be in the
interest of safety when the following events or behavior is displayed, including (but not limited
to) inappropriate behavior, illegal substances or actions, excessive intoxication with alcohol,
personal health/medical issues, endangering the safety of others or the yacht, as well as any other
reasonable circumstances.
Personal health and medical conditions
It is the responsibility of the Client to inform Blue Island Adventures before a booking is made,
of any personal health issues, allergies, pregnancy, and other medical/health related conditions.
These details should be included in The Charter Booking Form.
Furthermore, Blue Island Adventures ultimately reserves the right to decline bookings made by
the Client or decline entry on board the vessel, where the company deems that their health
conditions is inappropriate for the charter.
Illegal Substances
The Client and guests shall not bring onto the boat any substances, weapons or any other item
that is considered illegal under the Thai law. If the Thai law is violated, Blue Island Adventures.
shall return the boat to shore immediately where the authority will take custody of the offender.
Vessel usage
In addition to the terms of usage stipulated herewith, usage of the vessel, including all details
regarding number of people, shall be exactly as filled in Charter Booking Form only.
Furthermore, the following rules should be adhered to at all times:
Pets – the Client and guests are prohibited to bring on board any pets or animals without full
written permission from Blue Island Adventures
Smoking – is FORBIDDEN in any interior space on board the yacht. Whilst smoking outside, the
Client is requested to take maximum care with cigarettes, ashes and the decks of the yacht, using
only the ashtrays provided.
Liability
Blue Island Adventures shall ensure that the vessel is insured against all customary risks for a
yacht of her size and type. I hereby forever and unconditionally release Blue Island Adventures
(“Business”), and its affiliated entities, parent companies, subsidiaries, present and former
employees, owners, officers, members, managers, partners, contractors, insurers, shareholders,
and directors (collectively “Released Entities”), from any and all claims, actions, damages,
liabilities, losses, costs, and expenses (including, without limitation, attorney’s fees) for death,
injury, loss or damage of property, (collectively “Claims”) in any way arising out of my
participation in the Charter, including, without limitation, any and all Claims resulting from the
negligence of the Released Entities. Business’s liability to me will be limited to actual damages
arising from Released Entities’ gross negligence or willful misconduct in the performance of
their duties and responsibilities hereunder; provided, however, under no circumstance shall my
damages in connection with my participation in the Charter be greater than $400. Recovery of
such amount shall be my sole and exclusive remedy. All liability arising out of my participation
in the Charter is cumulative and not per incident. In no event shall Business be liable for any
special, incidental, punitive, or consequential damages or other indirect damages, even if
Business has been informed of the possibility thereof. If I file a lawsuit against Blue Island
Adventures, I agree to do so solely in the country of The Bahamas, and I further agree that the
substantive law of The Bahamas shall apply in that action without regard to the conflict of law
rules of that country.
The above terms and conditions have been agreed upon by the Client when signing Charter
Booking Form.
